Keep Your Eye on the Ball: Survey and Fraud Enforcement Update for Home Health and Hospice

Although not strangers to federal surveys, home health agencies, and hospices will need to become familiar with new survey processes and enforcement remedies. Experts from Wiggin and Dana Law Firm will provide a legal update on the survey and fraud enforcement initiatives and recent case developments. Attendees will review the federal process for appealing survey findings and alternative sanctions, including new penalties for hospices, and hear about the Department of Justice and Office of Inspector General’s priorities.

Jody Erdfarb, J.D., Partner, Wiggin and Dana’s Health Care Department, advises a wide range of healthcare organizations such as hospitals, long-term-care providers, behavioral health clinics, individual practitioners, and information technology companies. Her expertise includes compliance, fraud and abuse, False Claims Act, HIPAA, patient care, and regulatory and corporate matters. She assists providers with state and federal survey issues, handles compliance and informal dispute resolution meetings, appeals deficiencies with the Centers for Medicare and Medicaid Services, manages Medicaid audits, and responds to governmental subpoenas.

Jolie Apicella, J.D., Partner, Wiggin and Dana’s Litigation Department and Health Care Practice Group, is a seasoned attorney and skilled negotiator with extensive experience in healthcare regulations, investigations, and litigation. She focuses on complex civil litigation, alternative dispute resolution, and trial practice. Jolie also provides regulatory and compliance counsel, represents clients in appeals of Medicare reimbursement decisions arising under the Administrative Procedure Act and Medicare Statute, and counsels clients on healthcare litigation and qui tam matters.
